Dear Director Trejo, 

The following letter is ultimately intended for The Honorable Andy Harris, Chairman, US House Freedom Caucus.

Observing that Congressman Harris is [… my representative in the US House … or … one of my top representatives in the federal government], I urge him to stop the stablecoin trap, specifically, vote against the Genius Act (S. 1582) or similar stablecoin legislation such as the Stable Act (H.R. 2392); moreover, to vote for deep, responsible reform of the abusive regulatory regime that the Bank Secrecy Act and Patriot Act unleashed. Last but not least, I urge him to advance without delay additional legislation that would responsibly solve the debt crisis without recourse to the false stablecoin solution, namely, dollar-backed, including treasury-bond backed, stablecoin.

I don’t want to run the risk of living under total financial control. Everyone I know feels the same way. 

Anyone can see that the establishment of a central bank digital currency (CBDC) is totally unacceptable and would pose a dire threat to freedom. But a CBDC could be imposed through a back door. The Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations coming out of the Bank Secrecy Act and Patriot Act have been irresponsibly intruding more and more into the public’s financial records. (Regulators routinely operate beyond the scrutiny of elected officials; warrantless wiretaps and searches of all kinds are commonplace.) On top of that, a lot of our money is digitized, making it easy to apply the increasingly abusive KYC and AML regulations. The Genius Act and similar stablecoin legislation could be the final nail in the coffin, handing us over to digitized, total financial control and God knows what else.

I applaud President Trump for having issued Executive Order 14178 insofar as he banned a CBDC. Don’t then push the Genius Act and similar Stable Act which would enable a CBDC back door. Specifically, Acts like these would do three horrendous things: 

• Acknowledge and reinforce the Bank Secrecy Act and Patriot Act.
• Establish a dollar-backed cryptocurrency called stablecoin, which is surveillable, programmable and seizable, just like a CBDC would be.
• Make it very likely that the very private banks who control the central bank (Federal Reserve) would control the sanctioned stablecoin issuers.

To talk about stablecoin being a “retail digital currency” is disingenuous. It’s a corporate version of a CBDC! If enough Americans use stablecoin of the Genius-Act type, then the private interests who control the Fed would most likely be in a position to take us over completely and tell us what we could buy and not buy, sell and not sell.

From an even higher vantage point, the Genius Act seems quite consistent with the grave threat to freedom inherent in the push for a digital ID and for a universal digital ledger, whereby all property, having been digitized, could be tracked, programmed and controlled by a central authority.

It’s not comforting at all that the Genius and similar Stable Act do not mandate the use of stablecoin. To enact such a bill into law is to invite incremental use or to invite incrementalism, which, in turn, is followed by an out-of-the-blue mandate. A debt default – see below – could provide the pretext for a mandate. Other pretexts for a mandate are conceivable, too. (For years, the public has been increasingly goaded into accepting cryptocurrency including stablecoin.)   

There has been a lot of talk about treasury-backed stablecoin solving the debt crisis or, at any rate, saving us from a debt default. As I understand it, the public debt amounts to obligations to finance treasuries. The Genius Act and Stable Act allow for $1 of stablecoin to be backed by $1 of treasuries. Stablecoin could serve as an “off-ramp” for treasuries, allowing the debt ceiling to go up and up. It sounds good until we remember that such stablecoin is a CBDC back door. And another thing – to perpetuate the treasuries-backed dollar system is to perpetuate the bonanza going to the superrich who are the foremost beneficiary of the system. 

Yes; Congress needs to solve the debt crisis now. But turning to a dollar-backed, including treasury-backed stablecoin is hardly a solution!

For all that, the promotions of the Genius Act and similar Stable Act have done the country a favor. Attention is being drawn to monetary policy – to currency and credit, banking and the Fed – before the next colossal banking crisis, on the order of 2008 or 1929 or worse, strikes. I call on you to seize this opportunity, not only opposing the stablecoin back door to a CBDC, but also rolling back the grave abuses of the Bank Secrecy Act and Patriot Act, and even legislating a responsible solution to the debt crisis, which necessarily rules out the use of dollar-backed, including treasury-backed stablecoins.

Please take a good look at American economic history. There’s a lot of debt solutions that have worked in the past and could work again with a little adjusting or updating. This country has an amazing currency and banking history; we’ve run lots of monetary experiments; lessons of what works and doesn’t work abounds. Those of you on Capitol Hill surely have what it takes to figure out a path to safety and to stoke this economy as never before! Go to it! Godspeed!
